Shouyong Zhang and Shili Chen were accused of planning the killing of Jonathan McKinsey, an engineer in the games department of The New York Times, near a park in Dublin, Calif.

Judge Melissa R. DuBose said the department had placed arbitrary conditions on grants created by the Violence Against Women Act.

Jonathan McKinsey, an engineer who worked in the games department for The New York Times, was fatally shot Saturday in a San Francisco suburb. The police have accused his parents-in-law, both 76.
